This research investigates whether the procedural mechanisms in the Italian legal system allow sentences to meet their constitutional functions. It emphasizes the rehabilitative and resocializing roles of the penal system and analyzes the enforcement judge's powers in correcting unlawful sentences. A dogmatic and case-law-based approach will be employed to reconstruct procedural remedies during the enforcement phase.
